On 25 October 2023 the Court confirmed the Indictment in the case of Dragan Babić et al. (S1 1 K 046543 23 Kro), which charges the accused Dragan Babić and Milivoje Maletić with the criminal offense of War Crimes against Civilians under Article 173(1), Subparagraphs c) and f), of the Criminal Code of Bosnia and Herzegovina (CC BiH), and the criminal offense of War Crimes against Prisoners of War under Article 175a) CC BiH, all in conjunction with Articles 29 and 180(1) of the Code.

The accused are charged that during the war in Bosnia and Herzegovina and the armed conflict between the Army of BiH and the Croat Defense Council (HVO) on the one side, and the Army of Republika Srpska (VRS) on the other, in the territory of Teslić municipality, as VRS members, namely Dragan Babić as a detention facility warden, and then also as a military policeman, in the town of Pribinić, and Milivoje Maletić as a guard at the Pribinić detention facility, during a period between early June 1992 and not later than 10 August 1992, proceeded in violation of the rules of international humanitarian law and the provisions of the Geneva conventions, in the manner that the accused Dragan Babić - alone, in his capacity as the detention facility warden, committed, ordered, endorsed, enabled, allowed, agreed or in some other way participated in the inhuman treatment of non-Serb civilians and prisoners of war, and in the killing of non-Serb civilians; the accused Dragan Babić, in his capacity as the detention facility warden, and Milivoje Maletić as a guard at the detention facility - together, committed the offense of inhuman treatment of the then-detained non-Serb civilians and prisoners of war, held them in detention in inhuman conditions, beat them and inflicted on them injuries as well as heavy physical pain and mental anguish, so that one of the civilians died of the consequences; and the accused Milivoje Maletić - alone, as a guard at the detention facility, and the accused Dragan Babić - alone, as a military policeman, repeatedly accorded inhuman treatment to the civilians at the Pribinić detention facility.
