On 5 February 2025 the Court of Bosnia and Herzegovina confirmed an Indictment in the case of Ellvis Kelmendi et al. (S1 2 K 050706 24), charging the accused Ellvis Kelmendi and Ajlin Ahmić that, by the acts described in the Indictment, the two of them together, and with other persons known to them, committed the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195, as read with Articles 29 and 54 CC BiH, all in conjunction with Article 53 of the Criminal Code of Bosnia and Herzegovina, and that the accused Elvis Kellmendi alone also committed the criminal offenses of Provoking General Danger under Article 323 CC FBiH; Malicious Mischief under Article 293 CC FBiH, as read with Article 31 of the same Code; and Illicit Purchase, Keeping or Sale of Arms or Important Parts for Firearms under Article 65 of the Law on Arms and Ammunition in the Herzegovina-Neretva Canton, all in conjunction with Article 53 of CC BiH.
According to the Indictment, the accused Ellvis Kelmendi and Ajlin Ahmić, together with M.V., A.F., R.G., and other unidentified persons and persons known to them, between August 2019 and March 2021, in the territory of Bosnia and Herzegovina, Serbia, Montenegro and Albania, knowing full well that what they were doing was prohibited but nonetheless wanting to do so, with the aim of acquiring ill-gotten gain, carried out illicit purchase, turnover, sale and transfer of narcotic drugs, which they purchased in the territory of Albania, Kosovo, Serbia and Montenegro, and resold the drugs in the territory of Bosnia and Herzegovina, while using the specially set mobile phones for mutual communication, through installed Sky Ecc applications, intended for encrypted communication.
It is further said that the accused Ellvis Kelmendi, alone and with other persons known to him, on 12 March 2020 at around 8 p.m., in the territory of Sarajevo Canton, with the intent to cause fear in and inflict damage on A.S.’s property, knowing full well that he could cause danger to human lives and property on a large scale, after he instructed M.V. through the mobile device “Kripta”, concerning passenger motor vehicles, time and method in which to set the vehicle on fire, M.V. has, together with persons known to them, ignited flammable liquid he had previously poured on the passenger motor vehicle BMW X6, owned by A.S., by which he caused fire on the vehicle, which then spread onto the adjacent motor vehicles that were all ultimately completely destroyed.
