On 14 January 2025 the Court confirmed an Indictment in the case of Enes Zukanović et al. (S1 1 K 045068 24 Kro), charging the accused Enes Zukanović, Fikret Prevljak, Emir Redžović, Vahid Alađuz, Rasim Okerić, Mustafa Gegaj, Mujo Vatreš, Vahid Muharemović, Mirsad Tuzlak and Senahid Godinjak that, by the acts described in detail under individual counts of the Indictment for each accused, they committed the criminal offenses of War Crimes against Civilians under Article 173 CC BiH and War Crimes against Prisoners of War under Article 175 CC BiH.
The accused are, inter alia, charged that, during the war in Bosnia and Herzegovina and the armed conflict between the Army of the Republic of Bosnia and Herzegovina (ARBiH) and the Army of Republika Srpska (VRS), between May 1992 and late October 1995, in the territory of Hrasnica, Sokolović Kolonija and Butmir, Municipality of Ilidža, the accused Enes Zukanović, in his capacity as Commander of the Armed Forces Staff Ilidža, the accused Fikret Prevljak, originally in his capacity as Commander of the Armed Forces Staff Ilidža and then as Commander of the 4th Motorized Brigade of the Army of the Republic of Bosnia and Herzegovina (4th mtbr ARBiH), the accused Emir Redžović, in his capacity as Commander of the 104th mtbr ARBiH, the accused Vahid Alađuz, in his capacity as Assistant Commander for Security of the 4th mtbr ARBiH, the accused Rasim Okerić, in his capacity as warden of a camp in Hrasnica, the accused Mustafa Gegaj and Mujo Vatreš, in their capacity as members of the 4th mtbr ARBiH, subsequently of the 104th mtbr ARBiH, the accused Vahid Muharemović, in his capacity as the Ilidža Municipality Executive Board Chairman, the accused Mirsad Tuzlak, in his capacity as Commander of the Mixed Artillery Division of the 104th mtbr ARBiH, and the accused Senahid Godinjak, in his capacity as Commander of II Battalion of the 104th mtbr ARBiH, knowingly and willingly, each of them in the course of performing their duties or offices, by their acts, fully aware, wanting and consenting, enabled, allowed, agreed and organized the unlawful detention and abuse of Serb civilians and prisoners of war - members of the VRS, on the premises of the OŠ “Aleksa Šantić” elementary school, then also in the garages at the Igmanskih partizanskih bataljona street No. 11, and on the basement premises of the unfinished residential building at the Alekse Bojovića Brke street bb, which facilities had the character of camps, under the auspices of the Ilidža Armed Forces Staff.
The accused are also charged that, in the framework of their duties and offices, in violation of international law, they denied basic human rights to Serbs, in the manner that they committed unlawful detention, killing, rape, inhumane acts, inflicting violations of health and bodily integrity, forcing the detainees to engage in forced labor in the war theater, where they were exposed to wounding and lethal injuries, and the attack on the civilian population.
