Indictment confirmed in Babić et al.

On 13 January 2025 the Court of Bosnia and Herzegovina confirmed an Indictment in the case of Luka Babić et al. (S1 1 K 050718 24 Kro), charging the accused Luka Babić, Alojz Vrbić, Marinko Martić, Franjo Jozić, Viktor Markanović, Slavko Spajić and Ivo Mrkonjić with the criminal offense of War Crimes against Civilians under Article 173(1), Subparagraphs c), e) and f), of the CC BiH, as read with Article 180(2) CC BiH (in relation to the accused Luka Babić), and the criminal offense of War Crimes against Civilians under Article 173(1), Subparagraphs c), e) and f), of the CC BiH, as read with Articles 180(1) and 29 of the same Code (in relation to the accused Luka Babić, Alojz Vrbić, Marinko Martić, Franjo Jozić, Viktor Markanović, Slavko Spajić and Ivo Mrkonjić).

The accused are charged that, during the war and armed conflict in Bosnia and Herzegovina between the Croat Defense Council (HVO) and the Army of BiH in the territory of Žepče municipality, between 24 June 1993 and late March 1994, the accused Luka Babić, in his capacity as Commander of the 3rd Company, 4th Battalion, Vitez Military Police – with the Staff of the 111 Xp Brigade of the HVO, the accused Alojz Vrbić, Marinko Martić and Franjo Jozić, in their capacity as members of the 3rd Company, 4th Battalion, Vitez Military Police - with the Staff of the 111 Xp Brigade of the HVO Žepče, the accused Viktor Markanović and Slavko Spajić in their capacity as members of the 111 Xp Brigade HVO Žepče, and the accused Ivo Mrkonjić in his capacity as Head of the Žepče Police Department, acted in violation of the rules of international humanitarian law, in the manner that they committed various forms of mental and physical abuse and inhumane treatment of the Bosniak civilians who were unlawfully detained in improvised detention facilities at the Elementary School “Rade Kondić”, the Elementary School in Perkovići, at the “Silos” facility and “Stables” of Nova Trgovina, while the accused Marinko Martić is also charged with the rape of a Bosniak woman. The accused Luka Babić is also charged that, although he knew or had reason to know, he failed to take reasonable measures to prevent members of the 3rd Company 4th Battalion of the Vitez Military Police and members of the 111 Xp Brigade of the HVO from according inhumane treatment to the civilians detained in the foregoing facilities and from forcing them to perform forced frontline labor, which resulted in multiple civilian deaths and wounds.
