Indictment in the case of Milenko Živanović confirmed

On 31 December 2021, the Court of Bosnia and Herzegovina /BiH/ confirmed Indictment of the Prosecutor's Office of BiH dated 13 December 2021, charging the accused Milenko Živanović with the criminal offense of Crimes against Humanity under Article 172 paragraph 1 sub-paragraph (h) as read with sub-paragraphs (d) and (e), taken in conjunction with Article 180(1) and Article 29 of the Criminal Code of BiH.

According to the Indictment, in the period between 6 July and 1 November 1995, as part of a widespread and systematic attack directed against the Bosniak civilian population of the UN safe areas of Srebrenica and Žepa during which the Army of the Republika Srpska /RS/ and the Ministry of Interior of the RS carried out an operation of permanent and forcible transfer of the entire Bosniak civilian population from those safe areas and an operation of capturing, imprisoning and execution of around 8,000 men, the accused Milenko Živanović, with knowledge of that attack and that his acts constituted part thereof, acting individually and in collusion with other participants in a joint criminal enterprise with intention and common purpose of destroying in part a group of the Bosniak people of the Srebrenica enclave by way of forcible removal of the Bosniak civilians and summary executions, as Commander of the Drina Corps, planned and directed the activities of all the subordinated units in his area of responsibility and monitored their activities, independently and through the Drina Corps Staff, in order to ensure that his orders were being carried out.
