The Court of Bosnia and Herzegovina confirmed, on 23 May 2022, an indictment of the Prosecutor’s Office of Bosnia and Herzegovina of 13 May 2022, charging the accused Milenko Samardžija and Kosta Stanić with commission of the criminal offense of War Crimes against Civilians under Article 142(1) as read with Article 22 of the Criminal Code of the Socialist Federative Republic of Yugoslavia.
The indictment, inter alia, alleges that, by violating the rules of international law during the state of war in Bosnia and Herzegovina, as members of the Special Platoon of the Ministry of Interior of the Republika Srpska in Sokolac, along with several other persons, the accused Milenko Samardžija and the accused Kosta Stanić knowingly and willingly participated in depriving Bosniak civilians of their lives, although those persons were not, in any manner, active participants in the hostilities and military operations, as described in more detail in the indictment.
