The Court of Bosnia and Herzegovina confirmed, on 7 December 2021, an indictment in the case of Selmo Cikotić charging the accused Selmo Cikotić with the commission of the criminal offense of Abuse of Office or Official Authority under Article 220(3) of the Criminal Code of Bosnia and Herzegovina (CC BiH).
The indictment alleges that, during the period between 30 October 2009 and 12 July 2011, in a previous agreement with T.R., meanwhile deceased Assistant Defense Minister BiH and the other persons he knew, the accused Selmo Cikotić, in the capacity of Defense Minister of Bosnia and Herzegovina, abused his office, issued and signed two decisions approving delivery/change of the goods, four decisions on delivery of ammunition, and concluded four annexes to four basic contracts on the sales of non-perspective weapons and ammunition concluded during 2003 and 2004 between the previously authorized entity’s bodies and the SCOUT d.o.o. Company from Zagreb.
The indictment of the Prosecutor’s Office of BiH alleges that, having concluded the referenced annexes and having issued the decisions and procedural decisions at issue, the accused reduced large quantities of weapons and ammunition the buyer had more difficulties to sell on the market while increasing, at the same time, certain quantities of weapons and ammunition which the buyer could more easily sell on the market. In the referenced manner, the accused used to meet the requests made by the SCOUT d.o.o. Company Zagreb without any previous checking with the Defense Ministry the justifiability of such requests, having thus acted strictly in the buyer’s interest.
In the foregoing manner, the accused enabled the other party to obtain the property gain in a total amount of at least KM 4,111,725.67, having thus caused damage to the budget of Bosnia and Herzegovina in the amount of at least KM 9,709,468.04, as alleged in the indictment.
