On 5 April 2023 the Appellate Division Panel of the Court of Bosnia and Herzegovina delivered a second-instance judgment in the case of Petar Mitrović, dismissing as ill-founded the appeal filed by defense counsel for the accused Petar Mitrović, and upholding the Trial Judgment of the Court of BiH of 30 January 2023.
The Trial Judgment found the accused Petar Mitrović guilty that by the acts described in the operative part of the Judgment he committed the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(2) CC BiH, for which, pursuant to Article 217(2) CC BiH, and Articles 39, 42, 48, 49 and 50(1)e) CC BiH, he was sentenced to 5 (five) months of imprisonment. Pursuant to Article 217(4) CC BiH, the ill-gotten gain has been confiscated from the accused.
The accused Petar Mitrović has been found guilty that, while performing the duties and assignments of an authorized official person, police officer at the BiH Border Police, carrying out border control of persons and vehicles at the international border crossing of Gradiška between Bosnia and Herzegovina and Croatia, he received a benefit for himself so as not to perform an official act he was supposed to perform in the framework of his duties.
No appeal lies from this Judgment.
