On 7 July 2021 the Court of Bosnia and Herzegovina confirmed the Indictment in the case of Rade Macura, charging the accused Rade Macura with the criminal offense of War Crimes against Civilians under Article 173(1)c) of the Criminal Code of Bosnia and Herzegovina, as read with Article 180(2) of the Code.
According to the Indictment, during the war in Bosnia and Herzegovina and the armed conflict between the Army of Republika Srpska and the Army of the Republic of Bosnia and Herzegovina, as a member of the Army of Republika Srpska, Commander of the 1st Company, 2nd Battalion, 1st Light Gradiška Brigade, the accused Rade Macura proceeded in violation of the rules of international humanitarian law, specifically Article 3(1)a) of the IV Geneva Convention Relative to the Protection of Civilian Persons in Time of War of 12 August 1949, as well as Article 146, as read with Article 147 of the Convention, Article 87(3) of the First Additional Protocol to the Geneva Conventions of 12 August 1949, and Article 4, Paragraphs 1 and 2a), of the Second Additional Protocol to the Geneva Conventions of 12 August 1949.
