On 1 November 2022, in the case of Frano Gavranović et al. (S1 2 K 036587 20 K), the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment finding the accused Frano Gavranović and Duško Simikić guilty that by the acts described in the Conviction they committed the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH. The Court sentenced them to one (1) year of imprisonment each. Pursuant to Article 56(1) CC BiH, the time the accused spent in custody, from 24 January 2019 to 13 March 2019, shall be credited towards their sentence of imprisonment.

The accused Frano Gavranović and Duško Simikić are acquitted of the charges that in the manner described in the Acquittal they committed the criminal offense of Organized Crime under Article 250(2) CC BiH as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH, and the accused Adis Velagić of the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH. Pursuant to Article 284(1)c) of the BiH Criminal Procedure Code, the accused were acquitted of the charges because it was not proven that they committed the criminal offenses as charged.

An appeal from this Judgment may be filed with the Appellate Division Panel of the Court of BiH within 15 days of the day when a written copy thereof was received.
