The accused Milomir Savčić ordered into pre-trial custody

On 9 August 2021, the Court of Bosnia and Herzegovina issued a Decision revoking the prohibitive measures previously imposed on the accused Milomir Savčić, while granting the Motion filed by the Prosecutor's Office of Bosnia and Herzegovina on 2 August 2021 to order pre-trial custody in terms of Article 126f, Paragraph 2, of the Criminal Procedure Code of Bosnia and Herzegovina /CPC BiH/ on the grounds of his failure to observe the prohibitive measures imposed under Article 126a, Paragraph 1(c), of the CPC BiH, banning the accused from contacting any representative of the print and electronic media concerning the facts pertaining to this criminal case, or from making public addresses in connection with the case. On the Motion of the BiH Prosecutor's Office, the accused Milomir Savčić is ordered into pre-trial custody on the grounds of Article 132(1)(b) of the CPC BiH due to the concern that he might destroy, conceal, alter or falsify evidence or clues relevant to the criminal proceedings, and due to particular circumstances indicating that he will hinder the criminal proceedings by interfering with the witnesses, accomplices or accessories, not because of the flight risk.

 

Under the referenced Decision, pre-trial custody may last for a maximum of three (3) years running from the date of confirmation of the Indictment, i.e. until 13 January 2023 or pending a new decision of the Court.

In relation to the repeated inquiries from the media, please be advised that the Court has received an official note from the Court Police of Bosnia and Herzegovina stating that the accused Milomir Savčić has not been found at his home address, which was the reason why he was not brought to the Detention Unit under the Court's order. In view of the above, the Court has decided to issue an international arrest warrant.

 

The Prosecutor's Office of Bosnia and Herzegovina has received notification containing the official note that the accused Milomir Savčić was not found at his home address, in order to undertake further action from within the scope of its authority.

 

In order to provide objective information to the public, on the Motion of the BiH Prosecutor's Office the Court has ordered custody of the accused Milomir Savčić on the grounds of his violation of the prohibitive measures in relation to the specific case conducted before the Court of BiH, not because of his public addresses in relation to possible violation of the amendments to the Criminal Code of BiH pertaining to the ban on denying genocide and other war crimes, and glorification of war criminals.
