Decision issued by the Appellate Division Panel of the Court of Bosnia and Herzegovina on 24 August 2021, which was sent out on 26 October 2021, upheld the Prosecutor’s appeal from the Trial Judgment of the Court of BiH No. S1 1 K 018560 20 K of 12 March 2021. The Trial Judgment is now revoked in its entirety and a trial is ordered before the Appellate Division Panel of the Court of Bosnia and Herzegovina.
On 12 March 2021 the Court of Bosnia and Herzegovina delivered the Trial Judgment dismissing the charges that the accused Adem Kostjerevac committed the criminal offense of War Crimes against Civilians under Article 142(1) of the Criminal Code of SFRY.
In relation to the accused Adem Kostjerevac, charges were dismissed that during the war and the armed conflict in Bosnia and Herzegovina, as a member of the Military Police of the 1st Muslim Brigade Zvornik, Army of BiH, during a period from 18 September 1992 to 4 October 1992, in the territory of Zvornik municipality, he acted in breach of the rules of international humanitarian law, specifically Article 3(1), Subparagraphs a) and c), and Article 27 of the Geneva Convention Relative to the Protection of Civilian Persons in Time of War of 12 August 1949, by forcing a female civilian to sexual intercourse.
