A preliminary hearing judge of Section I for War Crimes of the Court of Bosnia and Herzegovina (BiH) today confirmed the second indictment against Gojko Janković. This indictment charges the accused with the criminal offense of crimes against humanity pursuant to Article 172 of the Criminal Code of Bosnia and Herzegovina.

This indictment alleges that Gojko Janković, as the leader of a paramilitary group, ordered, committed, aided or incited the rape of a Bosniac woman in the area of Foča between April 1992 and February 1993.

A trial involving Gojko Janković is already in progress before the Court of BiH.  The indictment in that trial alleges that the accused committed the criminal offense of crimes against humanity in the area of the Foča municipality.  Those proceedings were transferred to the authorities of BiH for further processing on 8 December 2005, pursuant to a decision of the International Criminal Tribunal for the former Yugoslavia.  Gojko Janković has been in custody ordered by the Court of BiH since that time.
