Judgment announced in the Saša Ćurčić case

On 14 September 2020 the Special 24(7) Panel of the Court of Bosnia and Herzegovina delivered a judgment in the Saša Ćurčić case, finding the accused Saša Ćurčić guilty of the criminal offense of Crimes against Humanity under Article 172(1) of the Criminal Code of BiH, as read with Subparagraph g) (coercing another to sexual intercourse or an equivalent sexual act - rape), all in conjunction with Article 180(1) CC BiH, and sentenced him to 5 (five) years of imprisonment.

 

The indictment charges the accused Saša Ćurčić that between 3 July 1992 and 18 July 1992, during which period there was a widespread and systematic attack launched by military, paramilitary and police forces of the Serb Republic of Bosnia and Herzegovina, subsequently Republika Srpska, against the Bosniak civilian population of the Foča municipality, knowing of the attack and that his actions constituted part of the attack, as a member of the above forces, together with other persons, he knowingly coerced the victim to sexual intercourse or an equivalent sexual act (rape), whereby he committed the criminal offense of Crimes against Humanity under Article 172(1)g), as read with Article 180(1) CC BiH.
