Having held a guilty plea agreement consideration hearing and a sentencing hearing, on 26 December 2023 the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment in the case of Milan Mićanović et al. (S1 2 K 047138 23 K), finding the accused Milan Mićanović, Vladan Kovačević and Bojan Ćalasan guilty that by the acts described in the operative part of the Judgment they committed the criminal offense of Organized Crime under Article 250(2) of the Criminal Code of Bosnia and Herzegovina (CC BiH) as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH.
The Court imposed the following sentences on the accused:
- the accused Milan Mićanović, 1 (one) year and 4 (four) months of imprisonment;
- the accused Vladan Kovačević, 3 (three) years and 6 (six) months of imprisonment;
- the accused Bojan Ćalasan, 1 (one) year of imprisonment.
Pursuant to Article 56 CC BiH, the time the accused Milan Mićanović and Vladan Kovačević spent in pre-trial custody shall be credited towards their respective sentences of imprisonment.
The Court also fined the accused Bojan Ćalasan with 15,000.00 BAM, which he must pay within 1 (one) year of the day when the Judgment becomes final.
The accused are also subjected to the security measure of confiscation of instrumentalities, as follows:
- from the accused Milan Mićanović the ill-gotten gain in the amount of 2,000.00 BAM;
- from the accused Vladan Kovačević the ill-gotten gain in the amount of 6,000.00 BAM;
- from the accused Bojan Ćalasan the ill-gotten gain in the amount of 1,000.00 BAM;
The accused Milan Mićanović, Vladan Kovačević and Bojan Ćalasan are charged that between 2020 and 2022, among other things, they joined a group for organized crime for the purposes of Article 1(22) of the Criminal Code of Bosnia and Herzegovina, organized by the accused Dragan Pejović, with the aim of enabling the organizer and group members, through mutual communication and arrangements with other persons, to organize, prepare and commit the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195 CC BiH, by transferring the narcotic drugs across the borders of Bosnia and Herzegovina, Serbia and Montenegro, for the purpose of their further sale in those countries and the EU countries, all for the purpose of obtaining ill-gotten gain.
