Having held a guilty plea agreement consideration hearing and a sentencing hearing, on 11 December 2023 the Court of Bosnia and Herzegovina pronounced a Trial Judgment in the case of Mitja Kontič et al. (S1 2 K 045078 23 K) finding the accused Mitja Kontič, Aleksandar Nikolić, Boris Grujić, Slaven Radinković, Jovan Šuman, Igor Zarić and Damjan Tepić guilty of the criminal offense of Organized Crime under Article 250(2) CC BiH, in conjunction with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) CC BiH.

The Court sentenced the accused Mitja Kontič to one (1) year of imprisonment. The time the accused spent in pre-trial custody, from 14 March 2023 onwards, shall be credited towards his sentence of imprisonment.

The Court sentenced the accused Aleksandar Nikolić to one (1) year of imprisonment. The time the accused spent in pre-trial custody, from 14 March 2023 onwards, shall be credited towards his sentence of imprisonment.

The Court sentenced the accused Boris Grujić to one (1) year of imprisonment. The time the accused spent in pre-trial custody, from 19 February 2023 to 22 February 2023, shall be credited towards his sentence of imprisonment.

The Court sentenced the accused Slaven Radinković to one (1) year of imprisonment. The time the accused spent in pre-trial custody, from 19 February 2023 to 17 March 2023, shall be credited towards his sentence of imprisonment.

The Court sentenced the accused Jovan Šuman to one (1) year of imprisonment. The time the accused spent in pre-trial custody, from 19 February 2023 to 17 March 2023, shall be credited towards his sentence of imprisonment.

The Court sentenced the accused Igor Zarić to one (1) year of imprisonment. The time the accused spent in pre-trial custody, from 19 February 2023 to 17 March 2023, shall be credited towards his sentence of imprisonment.

The Court sentenced the accused Damjan Tepić to one (1) year of imprisonment. The time the accused spent in pre-trial custody, from 19 February 2023 to 17 March 2023, shall be credited towards his sentence of imprisonment.

At the same time, the security measure of confiscation of items is imposed on the accused, and the ill-gotten gain shall be confiscated from them, as follows:

• from the accused Mitja Kontič the ill-gotten gain in the amount of 18,020.00 EUR.
• from the accused Slaven Radinković the ill-gotten gain in the amount of 150 BAM and 8,100.00 EUR
• from the accused Jovan Šuman the ill-gotten gain in the amount of 3,700.00 BAM and 3,400.00 EUR
• from the accused Igor Zarić the ill-gotten gain in the amount of 3,950.00 BAM and 15,190.00 EUR.

The accused are charged that they have become members of a group for organized crime, previously set up by persons known to them from Slovenia, with the aim of procuring narcotic drugs in the territory of Slovenia, their illicit international transfer and keeping – storing, and further sale of those drugs in the territory of Bosnia and Herzegovina, all for the purpose of obtaining ill-gotten gain.
