Decision of the Court of BiH on a Motion of the BiH Prosecutor’s Office to Order the Suspect Sreten Milošević into Custody

The Court of Bosnia and Herzegovina issued, on 16 December 2023, a decision granting in part a motion of the BiH Prosecutor’s Office of 15 December 2023 and ordering the suspect Sreten Milošević into custody. Pursuant to this decision, custody can last no longer than one month, running from the arrest day, namely no longer than 14 January 2024 or until a new decision of the Court.

The suspect Sreten Milošević has been ordered into custody on a grounded suspicion that he committed the criminal offense of Genocide under Article 171 of the Criminal Code of BiH, as read with Article 180(1) and Article 31 of the Criminal Code of BiH, as well as due to the existing particular custody ground set forth in Article 132(1) a) of the Criminal Procedure Code of BiH, that is, due to a risk of flight.

 

The Court dismissed as ill-founded the remaining part of the Prosecution’s motion to order the suspect Sreten Milošević into custody on a particular custody ground set forth in Article 132(1) b) of the Criminal Procedure Code of BiH, namely a risk that the suspect will destroy, conceal, alter or forge the evidence and the traces relevant to the criminal proceedings, exert influence on witnesses, accomplices and concealers.
