Court’s ruling on Prosecutor’s Motion to order custody and restrictive measures against suspects in Edina Brutus et al.

In the case of Edina Brutus et al. on 20 March 2024 the Court of Bosnia and Herzegovina granted the Motion filed by the Prosecutor's Office of Bosnia and Herzegovina on 19 March 2024, and issued a decision imposing on the suspect Melvedin Jašarević the following restrictive measures:

  • travel ban
  • mandatory periodical reporting to a state authority
  • ban on meeting with specific individuals, in the manner that the suspect is prohibited from meeting and contacting, in any manner whatsoever, the other suspects in this criminal matter: Edina Brutus, Elma Brutus, Kaja Imširović, Damir Žuga, Hajriz Bećirović and Salvatore Giuseppe Maria Messina, and approaching them at a distance shorter than 50 (fifty) meters, as well as from meeting and contacting, in any manner whatsoever, the witnesses for the Prosecution in this criminal matter.

 

The imposed restrictive measures will last for as long as necessary, while their justifiability shall be checked on a bimonthly basis.

The suspect is particularly warned that he may be remanded in custody if he fails to comply with the measures imposed by the Decision.

 

In the same case, on 20 March 2024 the Court sent out a Decision dismissing the Prosecutor's Motion to remand the suspects Edina Brutus, Elma Brutus, Damir Žuga, Kaja Imširović and Hajriz Bećirović in custody.

 

At the same time, the following restrictive measures are imposed on the suspects Edina Brutus, Elma Brutus, Damir Žuga, Kaja Imširović and Hajriz Bećirović:

 

In relation to the suspects:

  • Edina Brutus, Elma Brutus, Damir Žuga, Kaja Imširović and Hajriz Bećirović, ban on leaving the place of residence, and ban on meeting with specific individuals
  • Edina Brutus, ban on leaving the address of residence and mandatory periodical reporting to a state authority
  • Elma Brutus, ban on leaving the place of residence and mandatory periodical reporting to a state authority
  • Damir Žuga, ban on leaving the place of residence and mandatory periodical reporting to a state authority
  • Kaja Imširović, ban on leaving the address of residence
  • Hajriz Bećirović, ban on leaving the place of residence and mandatory periodical reporting to a state authority.

 

The imposed restrictive measures will last for as long as necessary, while their justifiability shall be checked on a bimonthly basis.

The suspects are particularly warned that they may be remanded in custody if they fail to comply with the measures imposed by the Decision.

An appeal from the Decision shall not stay its execution.

 

The foregoing persons are suspected of committing the criminal offense of Organized Crime under Article 250, Paragraphs (2) and (3), of the CC BiH, as read with the criminal offense of Money Laundering under Article 209(3) CC BiH, and the criminal offenses of Special Cases of Forgery of a Document under Article 374 CC FBiH, Certification of Untrue Content under Article 375 CC FBiH, and Fraud under Article 294 CC FBiH.
