Appeals Judgment sent out in Senad Gadžo et al.

Having held a session on 30 November 2023, the Appellate Division Panel of the Court of Bosnia and Herzegovina has sent out an Appeals Judgment in the case of Senad Gadžo et al. (S1 1 K 041969 23 Krž), by which it refused as ill-founded the appeal filed by the Prosecutor's Office of Bosnia and Herzegovina, and upheld the Judgment of the Court of BiH dated 30 May 2023.

The Trial Judgment of the Court of BiH, dated 30 May 2023, acquitted the accused Senad Gadžo, Zaim Laličić and Suljo Hebib of the charges that they committed the criminal offense of War Crimes against Civilians under Article 142(1) CC SFRY, as read with Article 22 of the Code, on individual counts of the Indictment, as specified in the operative part of the Trial judgment.

 

The accused Senad Gadžo, Zaim Laličić and Suljo Hebib were acquitted of the charges because it was not proven that by the acts described in detail in the operative part of the Judgment they committed the criminal offenses they were charged with in the Indictment – War Crimes against Civilians under Article 142(1) of the CC SFRY, as read with Article 22 of the Code, pertaining to the killing and inhumane treatment of detained Serb civilians in the territory of Hrasnica in the second half of 1992.
