On 28 December 2023 the Court of BiH confirmed the Indictment in the case of Guanghua Xiang et al. (S1 2 K 028012 23 Ko) charging the accused Guanghua Xiang and the legal entity “BU-BU-GAO“ d.o.o. with the criminal offense of Tax Evasion or Fraud under Article 210(1), and the legal entity BU-BU-GAO“ d.o.o.  also in relation to Article 124 of the Criminal Code of Bosnia and Herzegovina.

The accused are charged that in February 2023, Guanghua Xiang, in his capacity as director and responsible person to represent the legal entity “BU-BU-GAO d.o.o.”, located at the Arizona Market, in an attempt to evade the payment of dues prescribed by the BiH legislation, knowingly providing false data that are essential for determining tax obligations of the legal entity “BU-BU-GAO d.o.o.”, specifically false data on taxable income and other facts of relevance to determining the amount of tax dues, in the manner that he knowingly and deliberately failed to enter proper amounts into the business records of the legal entity, and did not report them to the ITA BiH via submitted self-taxation reports, nor has he calculated Value/Added Tax in the total amount of 24,189.46 BAM, which is the amount the BiH budget has thus been deprived of, while the legal entity “BU-BU-GAO d.o.o.” had at its disposal such an ill-gotten gain, made on behalf and for the benefit of the legal entity by the accused Guanghua Xiang in his capacity as director and responsible person to represent the legal entity.
