Indictment confirmed in Nijaz Halilović et al.

On 24 January 2024 the Court of Bosnia and Herzegovina confirmed the Indictment in the case of Nijaz Halilović et al. (S1 2 K 041113 24 Ko), charging the accused Nijaz Halilović and Đorđe Mijović with the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(1) of the Criminal Code of BiH.

The accused Nijaz Halilović and Đorđe Mijović are charged that, on 26 August 2021, at the international border crossing of Hum, municipality of Foča, in their capacity as official persons in the institutions of Bosnia and Herzegovina, being police officers at the BiH Border Police, assigned to Border Police Unit (JGP) Hum, namely Nijaz Halilović as the team leader at the border crossing, and Đorđe Mijović as a border control police officer, with the rights and obligations ensuing from the authority vested in them by the Law on the BiH Border Police, specifically Đorđe Mijović, during border control of passengers entering Bosnia and Herzegovina from Montenegro, having established that passenger E.X. did not have any proof of a negative PCR test or a rapid antigen test for virus SARS-CoV-2, a certificate of vaccination or a certificate issued by a physician that the person in question has had COVID-19, he told the passenger to leave the bus and enter the official premises of the BiH Border Police at the MGP Hum, where Nijaz Halilović was sitting. According to the Indictment, that is when Đorđe Mijović directly informed Nijaz Halilović about the current status of the passenger E.X., after which both police officers of the BiH Border Police, using the previous information that the passenger did not meet the prescribed requirements for entry in BiH, with the aim of obtaining ill-gotten gain, requested and received from the passenger E.X. a gift in the form of money, in the amount of 20.00 EUR not to carry out a duty they were obligated to carry out, and in that way made it possible for E.X. to enter BiH, i.e. they did not proceed in accordance with the Law on Foreigners.
