Indictment confirmed in Vidoje Blagojević et al.

On 5 February 2024 the Court of Bosnia and Herzegovina confirmed an Indictment in the case of Vidoje Blagojević et al., charging the accused:

  • Vidoje Blagojević with the criminal offense of Crimes against Humanity under Article 172(1), Subparagraphs a), e), i) and k), as read with Article 180(2) of the Criminal Code of BiH;

 

  • Ivan Arapović, Milan Arapović, Kosta Pejić, Božo Radić, Mile Savić, Mile Blagojević, Ljubiša Pejić, Stevo Vasiljević, Branko Pejić with the criminal offense of Crimes against Humanity under Article 172(1), Subparagraphs a), e), i) and k), as read with Article 180(1) of the Criminal Code of BiH, in conjunction with Articles 29 and 31 of the Code;

 

  • Verica Radović with the criminal offense of Crimes against Humanity under Article 172(1)a), as read with Article 180(1) of the Criminal Code of BiH.

 

According to the Indictment, between 31 May 1992 and 25 June 1992, in the territory of Zvornik municipality, during the war in Bosnia and Herzegovina and an armed conflict between the Army of Republika Srpska (VRS) and the Army of the Republic of Bosnia and Herzegovina (RBiH Army) in the territory of Zvornik municipality, and during a widespread and systematic attack launched by military, paramilitary and police forces of the so-called Serb Republic of BiH, subsequently Republika Srpska, targeting the Muslim civilians in the Zvornik municipality, which lasted from 8 April 1992 to at least late August 1992, knowing of the armed conflict and the widespread and systematic attack, and that their acts form a part of the attack, the accused took part in an unlawful detention and inhumane treatment of some 700 Muslim civilians imprisoned at the Technical School Center (TŠC) in Karakaj, and in the killing and enforced disappearance of at least 150 Muslim civilians, in the manner that the accused Ivan Arapović, Milan Arapović, Kosta Pejić, Bozo Radić, Mile Savić, Mile Blagojević, Ljubiša Pejić, Stevo Vasiljević, Branko Pejić, as members of the Karakaj Company, in their capacity as guards at the mentioned facility, in violation of Article 26 of the Law on the Army of the Serb Republic of Bosnia and Herzegovina, failed to protect the lives and health of some 700 detained Muslim civilians at the TŠC Karakaj, for even though they were guards at the TŠC Karakaj they did not prevent Serb soldiers P.S. (deceased), M.S. (unavailable), T. M. (deceased), who was a member of the Military Police, as well as other Serb soldiers who until 2 June 1992 were members of the TO Zvornik, and after 2 June 1992 members of the VRS Zvornik Brigade, to freely, on a daily basis, enter the part of the TŠC where the Muslim civilians were detained, after which these and other unidentified Serb soldiers beat the detained Muslim civilians, took the detained Muslim civilians outside of the facility, after which they have been unaccounted for, and killed the detained Muslim civilians. It is also said that the accused, with the intent to inflict great suffering, serious physical and mental pain, committed and aided and abetted in the act of detention or other grave acts of deprivation of physical liberty, and aided and abetted in the inhuman acts of similar nature, committed with the intent to inflict great suffering, serious physical and mental pain or deterioration of health, enforced disappearance and killing of the Muslim civilians.

 

The accused Vidoje Blagojević is charged that, as a person superior to the members of the Zvornik Brigade Karakaj Company, he failed to take the necessary and reasonable measures and launch proceedings to punish these members of the Karakaj Company and other members of the Zvornik Brigade for their aiding and abetting and participation in the inhuman acts of similar nature, committed with the intent to inflict great suffering, serious physical and mental pain or deterioration of health, enforced disappearance and killing of some 700 previously mentioned Muslim civilians.

 

The accused Verica Radović is charged that, in the afternoon hours of 1 June 1992, in front of the TŠC building in Karakaj – Municipality of Zvornik, she proceeded in violation of the rules of international humanitarian law by arriving in front of the TŠC building, after which the guards took two of the detained Muslim civilians from the TŠC premises, and one of the guards gave her a cocked pistol from which Verica Radović then, knowingly and willingly, fired and killed the two captives from close range.
