First Instance Judgment in the Case of Dušan Ćulibrk

The Court of Bosnia and Herzegovina delivered and announced, on 15 August 2022, the first instance judgment in the case of Dušan Ćulibrk - S1 1 K 038748 21 Kri, finding the accused Dušan Ćulibrk guilty of commission of the criminal offense of War Crimes against Civilian Population under Article 142(1) as read with Article 22 of the Criminal Code of the Socialist Federative Republic of Yugoslavia. The Court sentenced him to imprisonment for a term of 20 (twenty) years.

The accused Dušan Ćulibrk is found guilty because, during the state of war in Bosnia and Herzegovina, and an armed conflict between the army and the police of the Serb Republic BiH, subsequently Republika Srpska, and the Army of the Republic of Bosnia and Herzegovina, in the Municipality of Bosanska Krupa, during the period July-September 1992, in the capacity of a member of the reserve police force within the Public Security Station Bosanska Krupa, he acted in contravention of the rules of international humanitarian law in the territory of the Municipality of Bosanska Krupa, violating common Article 3 of the Geneva Conventions of 12 August 1949, in as much as he participated, as a co-perpetrator, in the killing of 51 Bosniak and Croat civilians.

The judgment may be appealed before the panel of the Appellate Division of the Court of BiH within 15 (fifteen) days after the receipt of a written copy of the judgment.

 

Following the announcement of the first instance judgment, the Panel ordered the accused into custody on the ground of a risk of his flight.
