On 20 August 2007, the Appellate Panel of Section I for War crimes of the Court issued a decision on appeals against the Trial Panel’s verdict. That decision upheld the appeals filed by the Prosecutor’s Office of BiH and the defence counsels of the accused Nikola Andrun and revoked the Trial Panel’s verdict dated 14 December 2006 and ordered a retrial before the Appellate Panel. The decision states that the appeals were upheld on the basis of essential violations of criminal procedure provisions and incorrectly established facts.
The Trial Panel found the Accused guilty of War crimes against civilians and sentenced him to 13 years imprisonment. The Trial Panel, inter alia, found that in 1993, acting in the capacity of Deputy Commander of the Gabela Detention Camp in the Municipality of Čapljina, and as a member of the Knez Domagoj Brigade of the Croatian Defence Council, Nikola Andrun acted contrary to the rules of international law.
