The operative part of the Verdict inter alia reads that the Accused Nuhanović and Pezić during 2007 and January 2008, together with persons known to them, as members of an organized group of people, prepared and organized the transfer of migrants from Serbia, Albania and Turkey to other countries who did not meet the conditions for a lawful entry and stay in the countries of final destination. The Accused took part in the preparation and organization of the transfer of migrants across the territory of Bosnia and Herzegovina to Croatia, and then further to the European Union countries, and in return they gained a certain amount of money.
With regard to the Accused Nuhanović, the Court issued a Decision to extend custody which under the Decision may last for no more than nine months. If during that period no second-instance verdict has been delivered to uphold or revise the first-instance verdict, the custody shall be terminated and the accused released. If within the nine months a second-instance decision is made to revoke the first-instance verdict, the custody may last for no longer than one year as of the day when the second-instance decision was issued.
With regard to the accused Pezić, the Court issued a Decision to extend the prohibitive measures imposed by the Court’s Decision dated 13 June 2008. According to the Decision, the imposed prohibitive measures may last until the accused is committed to serve his prison sentence or as long as there is a need for those measures.
