The Court of Bosnia and Herzegovina passed the Decision in the Srpko Pustivuk case ordering into one-month custody Srpko Pustivuk, suspected of committing the criminal offence of War Crimes against Civilians. Based on the Decision the custody may last not longer than 13 August 2010.

Having analyzed the submitted evidence, the Court was satisfied that there exists grounded suspicion that the suspect committed the alleged criminal offence. The custody has been ordered since it has been found that there exists a justified fear of the suspect’ flight. The Court also remanded suspect in custody because of the risk that if released he might hinder the inquiry by influencing the witnesses and accomplices. The suspect was also ordered into custody because of the exceptional circumstances which, in view of the manner of perpetration or consequences of the committed crime, indicate that the release of the suspect would result in an actual threat of public order disturbance.
