Milenko Lakić is suspected of the criminal offence of Organized Crime in violation of Article 250 of the CC of BiH in conjunction with the criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195 of the CC BiH and the criminal offences Aggravated Robbery under Article 289(2) of the CC FBiH, Murder under Article 166(2) of the CC FBiH and Provoking General Danger under Article 323 of the CC FBiH.
Following the review of evidentiary material the Court found that there existed grounded suspicion that the suspect committed the criminal offences he is charged with. The Court ordered the suspect Lakić into custody due to the fear that, if released, he might hinder the criminal proceedings by influencing the witnesses and accomplices. Furthermore, the Court ordered custody due to the particular circumstances which justify the fear that, if released, the suspect might repeat the criminal offence or complete the attempted criminal offence. In addition, the Court ordered custody due to the existence of exceptional circumstances since the criminal offence in question carries a prison sentence of ten years or a more severe punishment, and because, considering the manner of perpetration and the consequences of the criminal offence, his release poses a realistic threat in terms of public order disturbance.
