A Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina, having held the main trial, on 26 July 2018 pronounced a Judgment acquitting the Accused Rade Vlasenko, Drago Končar and Milan Krupljanin of the charges for the criminal offense of Crimes against Humanity in violation of Article 172(1)(h), as read with Sub-Paragraphs (a) and (k) of the Criminal Code of Bosnia and Herzegovina (CC B-H), all as read with Article 180(1) and Article 29 of the CC B-H.
The Accused are acquitted of the charges that in the period from 24 May 1992 to mid-August 1992, within a widespread and systematic attack of the military, police and paramilitary units of the Serb Republic of Bosnia and Herzegovina against the non-Serb civilian population of the Municipality of Prijedor, as members of the Army of the Serb Republic of Bosnia and Herzegovina (afterward the Army of Republika Srpska -- VRS), knowing of such attack, they participated, aided in and incited the persecution of the non-Serb civilian population in the region of Kozarac and the neighboring places in the Municipality of Prijedor, on religious, national and ethnic grounds.
Pursuant to Article 283(d) of the Criminal Procedure Code of B-H (CPC B-H), charges are dismissed against the Accused Rade Vlasenko that on an undetermined date in July or early August 1992, after he had come to the Trnopolje camp armed with firearms, together with one VRS member he took out of the camp three detained civilians whom they took to the place of Brđani, Prijedor Municipality, for forced labor, on which occasion they opened fire and killed one person, whereby he would have committed the criminal offense od Crimes against Humanity in violation of Article 172(1)(h), as read with Sub-Paragraph (a) of the CC B-H and Article 180(1) and Article 29 of the CC B-H.
Pursuant to Article 189(1) of the CPC B-H, the costs of the criminal proceedings shall be covered from the budget.
Pursuant to Article 198(3) of the CPC B-H, the injured parties are instructed to pursue their claims under property law in a civil action.
