Having held a hearing before a Panel of the Appellate Division of the Court of BiH, on 25 October 2022 the Court of Bosnia and Herzegovina delivered and pronounced an Appeal Judgment finding the accused Radenko Sukara guilty of the criminal offense of Fraud in Office under Article 222(1) of the Criminal Code of Bosnia and Herzegovina. The Court imposed on him a suspended sentence of one (1) year of imprisonment, while ordering that the sentence shall not be executed unless the accused commits another criminal offense within three (3) years of the day when the judgment becomes final.
The accused has been found guilty that between 26 March 2018 and 31 December 2020, in Bosansko Grahovo, in his capacity as an official person in the institutions of Bosnia and Herzegovina, performing the duties of a BiH Border Police commander, in order to obtain ill-gotten gain, and to become eligible for accommodation costs, he and B.G. concluded a fictitious apartment lease contract although he never lived in the given apartment at all, nor did he have any intention of living there, and thus damaged the BiH budget in the amount of 8,871.50 BAM, which was paid to him over the given period in monthly installments of 300.00 BAM, in accordance with the BiH Security Ministry Decision on the exercise of the right to accommodation reimbursement.
Pursuant to Article 222(4) CCBiH, the ill-gotten gain in the amount of 8,871.50 BAM shall be confiscated from the accused.
The Trial Judgment of 31 March 2022 acquitted the accused Radenko Sukara of the charges that he committed the criminal offense of Fraud in Office under Article 222(1) of the Criminal Code of Bosnia and Herzegovina. The Trial Judgment was rescinded by the Appellate Division Panel’s decision of 14 July 2022, and a trial was ordered before the Appellate Division Panel of the Court of Bosnia and Herzegovina.
