Second-instance judgment in the case of Adis Abaz

Panel of the Appellate Division of the Court of Bosnia and Herzegovina /BiH/ delivered a second-instance Judgment in the case of Adis Abaz (S1 2 K 032157 22 Kž2) on 12 May 2022, dismissing as ill-founded the appeals filed by, respectively, the Prosecutor's Office of BiH, counsel for the accused Adis Abaz and the Accused himself and upholding the first-instance Judgment of the Court of BiH No. S1 2 K032157 20 K dated 21 February 2022.

Under the first-instance Judgment of the Court of BiH, the accused Adis Abaz was found guilty of the criminal offense of Organized Crime under Article 250(3) of the Criminal Code /CC/ of BiH, as read with the criminal offense of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the CC BiH. The Court sentenced the Accused to six (6) years' imprisonment.

 

The accused Adis Abaz is guilty because he, from the first half of 2018 until mid-August 2018, in concert with Deni Stanišić, Admir Mahmutagić, Sumedin Topčagić and Zlatan Jure, joined a group for organized crime that he founded. The group was organized for the purpose of illicit international sale, transfer, transport, possession, mediation in further international sale, import and export, and delivery of narcotic drugs of marijuana – cannabis and amphetamines.
