Appeals Judgment in Malko Koroman Case

On 6 June 2022 the Appellate Division Panel of the Court of Bosnia and Herzegovina delivered and on 15 July 2022 sent out an Appeals Judgment in the Malko Koroman case, dismissing as ill-founded the appeal filed by the BiH Prosecutor's Office and upholding the Trial Judgment No. S1 1 K 033743 19 Kri of 24 January 2022.

The Trial Judgment of the Court of Bosnia and Herzegovina acquitted the accused Malko Koroman of the charges that he committed the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Article 180(1) of the Criminal Code of Bosnia and Herzegovina.

 

The Indictment, inter alia, alleges that between late March 1992 and December 1992, as part of a widespread and systematic attack of the Army of the Serb Republic of Bosnia and Herzegovina (subsequently: Army of the Republika Srpska), the Ministry of Interior of the Serb Republic of Bosnia and Herzegovina (subsequently: the Republika Srpska), and Serb paramilitary formations, directed against the Bosniak civilian population of Pale municipality, the accused Malko Koroman, with knowledge of that attack and that his acts constituted part thereof, performed the duties of Chief of the Pale Public Security Station /Pale SJB/. The Accused managed the Pale SJB by organizing its operations, directing and coordinating the activities of members of the active and reserve police of the Pale SJB and the Special Police Unit of the Pale SJB, being responsible for the lawful performance of duties and tasks of police offices of the Pale SJB as their superior and having effective control over them. The accused, acting with discriminatory intent, persecuted the Bosniak civilians of Pale municipality on national, ethnic, cultural and religious grounds by way of unlawful imprisonment, inhumane detention in inhumane conditions in violation of fundamental rules of international humanitarian law.
