Appeals Judgment delivered in Kemal Čaušević case

On 26 May 2023, the Appellate Division Panel of the Court of BiH delivered and pronounced an Appeals Judgment in the case of Kemal Čaušević, by which the accused Kemal Čaušević, pursuant to Article 284c) of the Criminal Procedure Code of Bosnia and Herzegovina, was acquitted of the charges that he committed the criminal offense of Money Laundering under Article 209(3) as read with Paragraphs 2 and 1 CC BiH, all in conjunction with Article 54 CC BiH.

Pursuant to Articles 110 and 111 CC BiH, as read with Article 217(4) CC BiH, the ill-gotten gain obtained by the commission of the criminal offense of Accepting Gifts and Other Forms of Benefit under Article 217(1) CC BiH shall be confiscated from the accused Kemal Čaušević in the amount of 1,722,000.00 BAM, as determined in a previous final judgment of this Court, which also sentenced the accused to five (5) years and six (6) months of imprisonment.

 

A previous judgment of the Appellate Division of the Court of 19 April 2022 had granted the accused’s appeal and revoked the Trial Judgment of 27 May 2021 in Section 2 of its Operative Part, which pertains to the criminal offense of Money Laundering under Article 209(3) as read with Paragraphs 2 and 1 CC BiH, all in conjunction with Article 54 CC BiH, and ordered a trial before the Appellate Division Panel of the Court of BiH.
