Trial Judgment pronouncement in the case of Rade Garić

The Court of Bosnia and Herzegovina will Monday, 16 August 2021, pronounce the trial judgment in the case of Rade Garić. Judgment pronouncement has been scheduled for 9 a.m. in Courtroom 6. 

The accused Rade Garić is charged with the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraphs a), e), f), g) i) and k), all in conjunction with Articles 29 and 180(1) of the Criminal Code of Bosnia and Herzegovina.

According to the Indictment, between April 1992 and late 1992, in the municipality of Vlasenica, in the framework of a widespread and systematic attack launched by the Serb Municipal Headquarters of Vlasenica Territorial Defense, para-military formations, the Army of Serb Republic of Bosnia and Herzegovina, subsequently the Army of Republika Srpska, the Ministry of Interior of the Serb Republic of Bosnia and Herzegovina, i.e. of Republika Srpska, and part of the Yugoslav People’s Army (JNA), specifically the JNA’s Novi Sad Corps, directed against the Bosniak civilian population of the Vlasenica municipality, knowing of the attack and that his acts form a part of the attack, the accused Rade Garić committed persecution of the Bosniak civilian population of the Vlasenica municipality on political, national, cultural, ethnic and religious grounds by way of killing, incarceration and other severe forms of deprivation of liberty in violation of the fundamental rules of international law, by way of torture, rape, enforced disappearance of persons and other inhumane cats of similar nature committed with the intention to inflict great suffering and serious bodily and mental harm and health deterioration.

 

The accused Rade Garić is also charged that during a widespread and systematic attack launched between 6 July and August 1995 by the Army of Republika Srpska and the Ministry of Interior of Republika Srpska, directed against the Bosniak civilian population of the UN Srebrenica Safe Area, in his capacity as Commander of the Vlasenica Brigade Intervention Platoon, knowing of the attack and that his acts formed a part of the attack, he committed persecution of the Bosniak civilian population by inflicting on them serious bodily and mental harm and killings.
