Gojko Janković transferred to Bosnia and Herzegovina

The Court of Bosnia and Herzegovina has ruled that custody ordered by the International Criminal Tribunal for the former Yugoslavia (ICTY) against Gojko Jankovic should remain in force. The accused Gojko Jankovic was transferred earlier today from the United Nations Detention Unit in Scheveningen to Bosnia and Herzegovina following a decision rendered by the ICTY.
The decision issued by the Court of Bosnia and Herzegovina set a 65-day deadline, starting from 12 December 2005, to the Prosecutor's Office of Bosnia and Herzegovina, within which the Prosecutor's Office needs to adapt the ICTY indictment pursuant to the provisions set forth in the Criminal Procedure Code of Bosnia and Herzegovina.
The transfer procedure for the accused was carried out successfully as a result of joint cooperation of the Registry and the Office of the Prosecutor of the ICTY with the BiH Prosecutor's Office, the Court of BiH, the Registry of the Court of BiH, State Investigation and Protection Agency (SIPA) and Court Police of the Court of BiH.
The decision to refer the Janković case to Bosnia and Herzegovina is the second legally effective decision of this type, confirming the ICTY’s confidence that Bosnia and Herzegovina has met all requirements for trying war crimes according to the highest international standards.

ICTY Indictment
The amended indictment brought against Gojko Janković by the Office of the Prosecutor of the ICTY on 7 October 1999 charges the accused on the basis of individual criminal responsibility (seven counts for Crimes Against Humanity, and seven counts for Violation of the Law and Customs of War), and on the basis of Criminal Responsibility in his Capacity of Superior (two counts for Crimes Against Humanity and two counts for Violation of the Law and Customs of War). These crimes are alleged to have been committed in the Foča region and its environs.
