Appellate Panel modifies Radovan Stanković’s sentence to 20 years long term imprisonment

On 28 March 2007, the Appellate Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina (BiH) handed down the final verdict in the case of Radovan Stanković, modifying the sentence handed down by the Trial Panel from 16 years to 20 years long term imprisonment. This final verdict completes the first case transferred to the authorities of BiH for further processing by the International Criminal Tribunal for the former Yugoslavia.

The Appellate Panel refused as unfounded appeals filed by Radovan Stanković and his Defence counsel.  It also refused the Prosecutor's appeal against the acquitting part of the first instance verdict, while upholding the appeal in respect of the convicting part of the verdict, where it relates to the criminal sanction.  The Panel concluded that the sentence imposed under the first instance verdict did not meet the purpose of punishment, and it therefore revised it.

Trial Panel found Radovan Stanković guilty of Crimes against humanity.  The Accused committed the said offence in the period August to October 1992 as a member of the Miljevina battalion (within the Foča tactical brigade), participating in a wide and systematic attack of the Army of the Serb Republic of BiH aimed against the non-Serb civilian population of the Foča municipality.

On orders of Dragoljub Kunarac, together with other individuals, Radovan Stanković formed a detention centre for women in the Karaman's house on 3 August 1992.  The Accused, together with other individuals, brought to the Centre, held captive, and supervised at least nine women, most of whom were juveniles.   The Accused claimed one of the detainees for his own use, forcing her into sexual intercourse every night except for a period of a few days after he had been wounded.  In October 1992 he transferred this detainee to another location at which he forced her into sexual intercourse and labour.

The time the Accused has spent in custody from 9 July 2002 will count towards the sentence.
