Appellate Panel delivered the Verdict in Mitar Rašević et al. case

The Appellate Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina (BiH) refused the appeal filed by the Prosecutor’s Office of BiH, partially granted the appeals filed by the Defense Counsel for Accused Rašević and Todović respectively, and modified the first-instance Verdict dated 28 February 2008 by which Accused Rašević and Todović were found guilty of the criminal offense of Crimes against Humanity and sentenced to 8 years and 6 months and 12 years and 6 months of imprisonment respectively.

 On 6 November 2008 the Appellate Panel delivered the second- instance Verdict by which the first-instance Verdict was modified in relation to the legal qualification of the criminal offense in as much as Accused Rašević and Todović are found guilty of Crimes against Humanity in violation of Article 172 (1) h) as read with sub-paragraphs a), c), d), e), f) i) and k) in conjunction with Article 29 and Article 180 (1) of the CC of BiH  for the activities described in the operative part of the first-instance Verdict. The Appellate Panel also modified the first-instance Verdict in the part related to Accused Rašević whereby Accused Rašević is found guilty of the criminal offense of Crimes against Humanity and sentenced to 7 years of imprisonment. The first-instance Verdict remains unchanged in other parts.
