Custody of the Accused in the case v. Ivan Zelenika et al.

The Court of Bosnia and Herzegovina issued the Decision on 19 September 2012 in the case v. Ivan Zelenika et al., terminating custody of the Accused Ivan Zelenika, Srećko Herceg, Ivan Medić and Marina Grubišić-Fejzić and ordering the following prohibiting measures:
  1. Prohibition from leaving the place of residence unless it is necessary for them to appear before the Prosecutor’s Office of BIH or the Court of BIH. The relevant police department will organize controls of the Accused every Monday, Wednesday and Friday in the period from 09,00 a.m. to 09,00 p.m., in order to check if they abide by the progibiting measures and inform the Court in writing about it;

 

  1. Travel ban including temporary withdrawal of travel documents – passports issued in their names by Bosnia and Herzegovina and the Republic of Croatia along with the prohibition of issuance of new travel documents, as well as the prohibition to use the identity card (issued by Bosnia and Herzegovina and the Republic of Croatia) for crossing the state border of Bosnia and Herzegovina;

 

  1. Ban on contacting, meeting and any kind of association with, including a ban on getting closer than 100 m to the co-Accused, witnesses listed in the Indictment and other persons who have any information about the present case.

 

The imposed prohibiting measures may last as long as necessary, while the review of their justifiability shall be carried out on a bimonthly basis.

 

If the Accused violate any of the imposed prohibiting measures, they may be ordered back into custody.

 

Accused Ivan Zelenika, Srećko Herceg, Edib Buljubašić, Ivan Medić and Marina Grubišić-Fejzić are charged with the criminal offense of Crimes against Humanity.
