Trial judgment pronounced in Đorđe Ristanić case

On 27 September 2022 the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment in the case of Đorđe Ristanić (S1 1 K 019836 15 Kri), acquitting the accused Đorđe Ristanić, pursuant to Article 284, Subparagraph c), of the CPC BiH, of the charges that by the acts described in the operative part of the Judgment he committed the criminal offense of Crimes against Humanity under Article 172(1)h) CC BiH, as read with Article 180(1) CC BiH.

The accused Đorđe Ristanić has been acquitted of the charges because it was not proven that in his capacity as President of the Brčko Municipality War Presidency, between April and December 1992, in the framework of a widespread and systematic attack aimed at the Bosniak and Croat population in the territory of Brčko municipality, knowing of the attack and that his actions form a part of that attack, having a discriminatory intent, as a member of a joint criminal enterprise, he committed persecution of people by way of murder, detention and other serious forms of physical liberty deprivation, forced transfer, torture and other inhumane acts of similar nature, committed with the intent to inflict great suffering or serious physical or mental injury, by denying the right to a fair and impartial hearing, by destroying cultural, historical and religious monuments that have been under special protection of international law, being listed as cultural and spiritual heritage sites.

 

An appeal from this Judgment may be filed with the Appellate Division Panel of the Court within 15 (fifteen) days of the day when a written copy thereof is received.
