Trial judgment pronounced in Malko Koroman case

On 24 January 2022, the Court of Bosnia and Herzegovina delivered and publicly pronounced a trial judgment in the Malko Koroman case, acquitting the accused Malko Koroman of the charges that he committed the criminal offense of Crimes against Humanity under Article 172(1)(h) of the Criminal Code of Bosnia and Herzegovina /CC BiH/, as read with Article 180(1) of the CC BiH. The judgment may be appealed with the Appellate Division Panel of the Court of BiH within 15 (fifteen) days of the day when a written copy of the judgment was received.

According to the charges, between the end of March 1992 and December 1992, as part of a widespread and systematic attack of the Army of the Serbian Republic of Bosnia and Herzegovina (subsequently: Army of the Republika Srpska), the Ministry of Interior of the Serbian Republic of Bosnia and Herzegovina (subsequently: the Republika Srpska), Serbian paramilitary formations directed against the Bosniak civilian population of Pale municipality, the accused Malko Koroman, with knowledge of that attack and that his acts constituted part thereof, performed the duties of Chief of the Pale Public Security Station /Pale SJB/. The Accused managed the Pale SJB by organizing its work, directing and coordinating the activities of members of the active and reserve police of the Pale SJB and the Special Police Unit of the Pale SJB, being responsible for the lawful performance of duties and tasks of police offices of the Pale SJB as their superior and having effective control over them. The accused, acting with discriminatory intent, persecuted the Bosniak civilians of Pale municipality on national, ethnic, cultural and religious grounds by way of unlawful imprisonment, inhumane detention in inhumane conditions in violation of fundamental rules of international humanitarian law.
