Custody ordered for Mitar Rašević and Savo Todović

At a custody hearing held on 3 October 2006, a preliminary hearing judge of Section I for War Crimes of the Court of Bosnia and Herzegovina issued a decision ordering custody of one month to the accused Mitar Rašević and Savo Todović.

The indictment confirmed by the International Criminal Tribunal for the former Yugoslavia charges Rašević and Todović with the criminal offences of Crime against humanity and Violations of law or customs of war.  The indictment alleges that before, during and after the war Mitar Rašević was the guards’ commander at the Foča Detention Facility (KP Dom).  Savo Todović was allegedly the second in command of the KP Dom prison staff from 20 April 1992 until 9 August 1993.  According to the indictment, in the period from 10 August 1993 until 31 October 1994, he continued to perform the duty of an Assistant Warden in the KP Dom.  The indictment charges the accused on the basis of individual and command responsibility for the persecution of the non-Serb population from the municipality of Foča, as well as torture, beatings, killings, imprisonment, inhumane treatment and enslavement of detainees in the KP Dom in Foča.

Following a public hearing the Court found that the submitted evidence established a grounded suspicion that the accused committed the offences referred to above.  Further, the Court concluded that the grounds for ordering custody were established on the basis of Article 132(1)(a)(d) of the CPC.  The Court found there was a risk of flight by the accused if released and took into account the fact that the penalty for the offences with which they are charged is 10 years imprisonment or more.

Custody under this decision may last until 3 November 2006, or a new decision of the Court.
