On 26 December 2006, the Court of Bosnia and Herzegovina (BiH) confirmed an indictment which charges Marinko Marić with War crimes against civilians.

The indictment alleges that as a member of the Croatian Defence Council Knez Domagoj Brigade (in the capacity of an investigator in the Brigade’s security and information service) in the second half of 1993 in the Gabela Camp, Municipality of Čapljina, Marinko Marić acted contrary to the provisions of the Geneva Convention relative to the Protection of Civilian Persons in Time of War.

The indictment, inter alia, alleges that on 10 August 1993, following the interrogation of two detainees in the Gabela Camp, the Accused ordered that one detainee, who was lying in a puddle of blood unconscious with a fracture to his scull, be taken out in front of the building and that water be poured into his mouth from plastic bottles.  As a result of this, the detainee allegedly died.

The indictment further alleges that on 30 September 1993, together with Nikola Andrun and another individual, the Accused participated in the beating and torture of one detainee.

The indictment states that the Accused is currently at large.
