The Accused Mitar Rašević and Savo Todović did not appear today before the Court of Bosnia and Herzegovina. The Court concluded that the Accused deliberately failed to appear on today’s hearing and recorded a plea of not guilty in accordance with the law.

The indictment alleges that in the period April 1992 to October 1994, Mitar Rašević and Savo Todović participated in a widespread and systematic attack of the army and police of the Republika Srpska and paramilitary formations aimed at the non-Serb civilian population of the Foča Municipality. The indictment further alleges that the Accused, together with the warden of the Foča Detention Facility (KP dom Foča), guards and other individuals participated in a joint criminal enterprise whose purpose was to imprison and keep in inhumane conditions in KP dom Foča all Muslims and other non Serbs from Foča and the surrounding areas.  KP dom Foča allegedly had all the characteristics of a detention camp.

The indictment alleges that Mitar Rašević, as the guards’ commander at the KP dom Foča was in charge of supervision of at least 37 guards over whom he allegedly had effective control.  The indictment further alleges that Savo Todović, in the capacity of the KP dom Foča warden’s deputy, exercised the powers and duties of the commander of the detention camp.

This case has been referred to the authorities of BiH for further processing pursuant to a decision of the International Criminal Tribunal for the former Yugoslavia.  The Accused were transferred to BiH on 3 October 2006.
