Custody of Mitar Rašević and Savo Todović terminated prohibiting measures ordered

The Court of Bosnia and Herzegovina issued the Decision dated 28 November 2008 terminating custody of Mitar Rašević and Savo Todović and ordering prohibiting measures which include the following:

 

  1. House arrest without prior approval of the Court, except when leaving the place of residence in order to appear before the Court or upon the summons of the Prosecutor’s Office of BiH;
  2. Temporary withdrawal of travel documents, ID cards and driving licenses issued by Bosnia and Herzegovina, Serbia and Montenegro authorities, along with the prohibition of issuance of new travel documents as well as the prohibition to use the identity card for crossing the State border of Bosnia and Herzegovina;
  3. Stay at the place of residence in Foča;
  4. Reporting to the Foča Public Security Station every Monday and Friday;
  5. Strict compliance with the orders and summons of the Court of BiH and availability to the Prosecutor’s Office of BiH.

Acting ex officio, the Court found that the nine-month deadline expired since the first-instance verdict was passed on 28 February 2008.  The Appellate Panel session was held within that deadline, namely on 6 November 2008.  Bearing in mind that the second-instance Verdict has not been passed yet, the Court terminated custody of Rašević and Todović by force of law and ordered prohibiting measures.

The first-instance Verdict dated 28 February 2008, found the Accused guilty of the criminal offence of Crimes against Humanity and sentenced Mitar Rašević to prison term of eight (8) years and six (6) months and  Savo Todović to prison term of twelve (12) years and six (6) months.
